When
placing accounts for legal forwarding, Creditor agrees
- to notify NACM
East Coast Collections promptly of all payments received
- to pay charges for
actual collections according to services rendered, in accordance with
the rate schedules in effect at the time of placing accounts,
conditions, and other information shown herein plus such other charges
and disbursements as may be mutually agreed upon.
- NACM East Coast is to
have the right to endorse for deposit and collection, in name of and
on behalf of the Creditor, checks or other negotiable instruments
received on accounts placed with it for collection, and to deduct any
applicable charges therefrom.
NACM East Coast agrees that
a Creditor may withdraw an account without payment of fees if there has
been no payment activity within three months of placement and the account
is not with an attorney.

NACM East Coast is authorized and
directed, as your agent and as a convenience to you, to tender the claim
to an attorney, subject to the following terms & conditions:
The right to choose an attorney is reserved to you.
When you desire to do so, you will send NACM the names of attorneys in
various locations or for specific cases to whom your accounts shall be
transmitted. Where you have not done so, NACM is authorized to tender the
account to any attorney selected by us.
If suit is recommended by your attorney, you will be
advised as to the requirements pertaining thereto. No suit shall be
commenced, no compromise shall be effected, no extension of time for
payment shall be granted and no expense chargeable to you shall be
incurred without your specific authorization. Recommendation for the
filing of any suit, or a proposed compromise, or an extension of any other
matter requiring a decision by you may be made directly to you by your
attorney if he or she desires. When you authorize a suit or an expense,
you agree to advance the necessary costs.
NACM is authorized and directed as your agent to
conduct on your behalf all routine correspondence with the attorney,
subject to your control, and all matters requiring a decision shall be
referred to you as stated above. |
